IR35
Anyone familiar with this cunt of a legislation?

I may need some practical advice shortly, as I don't want to fall foul of it. Been looking at buying some insurance against it, but not sure how much good it will do me and whether a better worded contract will be more useful.

Friendly tax men can apply however grassing ones can fuck right off.

As can the usual smart arses.

This is a huge part of what I do now and what I did before when I had an agency , I have studied the legislation over and over agan so like to think I have a grasp on it and know all the intricacies to look out for.

I could look over the contract for you and suggest any imendnents to ensure it is IR35 compliant.

Don't worry they only catch up with you in retirement when you have amassed a nice little nest egg. Offshore is the way to go.

WCW - This is what I thought. I'm getting a copy of their proposed contract (and this mob use Contractors all the time so it should be legit) then I'll make sure I add in substitution clauses and the like and get it reviewed by QDOS or something.

Make sure the contract is worded appropriately - that it is not limited to just you doing the work - that your company can supply a suitable substitute to do the work.

You should also be able to determine what hours you work and ideally where you work - as it's project based you should be determining which sites you go to and when rather than Company A telling you where and when to work.

You won't get hem into trouble - your contact will specify that your company is responsible for all employment taxes.

Sounds like a lot of effort doing it through an LTD.
I avoided all this ugliness by using an umbrella company and I always recommend people not to go LTD company unless they are really organised.

They seem to be doing less checking up lately, mainly due to groups like PSG putting up a fight.

Only need to watch out if you only work for one company all tax year.

I am technically a contractor although I don't use an agency - LTD Company.

I provide consultancy to a large company which is made up of many smaller companies in their own right.

I contracted for one small bit of it for 2 years, left, then subbed through a supplier of another part of the bigger company for 2 years on a particular project (the same project mind).

That smaller part of the bigger company want me to stay on that project as it has drastically overrun so I now have the option to contract direct rather than the sub I was doing before.

So invoice wise I'll have Company A (small bit A) for 2 years, Company B for two years, and now Company A (small bit B).

I'm not site specific, don't get holidays or claim expenses (claim off my own LTD) and can arguably claim I buy my own kit etc Got Prof Indem Ins and all that but because the ruling is so unclear I'm not sure about doing the Company A (small bit B) invoicing unless I a) get insurance or b) word my contract appropriately.

I also don't want to get either the larger company or the sub in trouble as it'll fuck my chances of going elsewhere for 6 months then coming back.

I've been jobbing over 25 years and I haven't heard of anyone who's got done. It was set up because of the idiot IT lot, who quite frankly should be permie anyway.

I'm guessing you're a contractor?

If you are and you are using an agency that is any good they should be able to advise you on what needs to be ammended in your contract to make it IR35 friendly thus avoiding the headache of extra tax being owed to HMRC.

Ditto the PCG recommendation.

In terms of contract, ultimately the contract is fairly meaningless as if you ever get assessed for it it will come down to the actual working practices in place, rather than the wording in a contract.
