Divorce, custody and housing... question...
Having done a lot of reading around this, I believe that if you own a house jointly then neither party in a divorce can be forced to leave by the other.

Has anyone actually done this i.e. got divorced and stayed in same house at least in short term? And what was effect on the kids?

Is the idea of doing this living in cloud cuckoo land (there is no third party involved so not THAT nasty situation, at least not yet)?

Fifth,

I am 2 years ahead of you.

After she wanted a divorce, she moved out to her mums. We went with mediation, who advised a 50/50 of assets was fair.

I stayed in the house until it was sold.

She has been through periods of being unable to communicate with and I would say my only advice is chose your words wisely from now on...even if it means holding certain things in
She doesn't like you at the moment, so will grasp anything to have ago at you. Be big and polite and civil at every encounter and agree to get through it with minimal stress and to keep what money you have away from lawyers.

Whomail for any advice.

All the best.

5th, i sincerley hope i'm wrong, but in my recent experience some woman (& men of course) have the capability to be the most cold hearted, greedy, bastards you could ever wish to meet.

Expect the very worst and plan & hope for the best bud.

Sorry if this is'nt what you wanted to hear but it's the reality mate.

Thoughts are with you man

Fifth , are you positive she has no one in tow , I'm very suspicious of a woman wanting to keep it amicable . I speak from experience.

my mate was the original batman for the fathers for justice lot, up on the roof of the royal court , he was a bodybuilder, i saw him on the news, and phoned him up to tell him how fat he looked, as he had loads of jumpers on underneath the costume, it must have got to him, he came down the next day

Fifth, i honestly hope it does for you and well done to your sister and her ex.

I would say plan for the worse and hope for the best.

good luck fells.

FWIW i think that when a couple split up then automatically both people should get 50 50 time and then have it done and dusted in court within a month. when a couple divorce they should not be allwoed to divorce unless the child arrangement orde ris also completed.

It is just so unfair on the kids that things drag on for.

My sister got divorced. She has one kid with her ex. They did everything very amicably and to this day (10 years later) still get on relatively well.

I just hope my Mrs is the same, she says she is going to be but I know it doesn't always work out like that.

Fifth, dont be deluded. her family will not as blood is thicker than water.

My 2 older kids haven't spoke to me for a year now. You may rememebr that one was very ill in hospital last year, a lot of whoers gave a lot fo money for a charity fundraiser, thank you, and sent lots of gifts and messages.

Doctors said they have never seen such a close dad and son bond, and yet his mother and her family have done all they can to sttop us from talking.

Cafcass and the courts as good for nothing as well.

The whole system is just ridiculous. been 18 months so far and still probably only half way through id imagine.

There is so much i have typed and then deleted as i don't want to be drawn to her level. Lets just say i have nothing nice to say about her and will hate her forever for what she has done and is doing to my kids.

If a normal person on the street did it then i'd be inside as i would have done them.

Mike, i'm sure you're right but i know and that's what matters most to me.

Fifth, I cant impress on you enough just to keep it kosher and my old mate the rabbi would say. Then what will be will be, but at least you've done everything you can do and correctly.

I've no sympathy for arsehole husbands who fuck around, get caught, don't pay maintenance and cant be arsed to see their kids but it seems to me that an awful lot of honest decent law abiding men get royally fucked over in the opposite direction

clubfoot , you may know it, but i bet your kids wont, women have a habit of playing the victim, and she WILL poison their minds against you, that goes without saying

Clubfoot that's horrible.

Given that her side of the family are largely on my side I hope they'd act as a restraint on her if she ever did come to that point and I know that my two at secondary school can see what she's like.

Not sure about my daughter though - she's still at primary school and potentially being separated from her is what's stopped me going down this road before and now keeps me awake at night.

Madeasy, i'm sorry to hear that mate. As you say nothing surprises you in the end but as hard as it is you cant let it make you bitter forever. Sure it's healthy to be angry but you rightly say the kids are ultimately the only losers and as far as i can tell lawyers are the only winners EVER.

My own ex-wife tried to restrict contact with my two infant sons to a contact centre in Tottenham (not close to where either of us lived at that time) as far as i could tell only to make life as unbearable as possible and i guessed so that she could try and to force me to agree to her ridiculous financial demands.

I refused on the basis of there being no grounds for such a situation or for such conditions being imposed and she got absconded with the kids and wouldnt even tell her solicitor where my sons were sleeping at night.

I didnt see my sons for 5 months.

she's a cunt. i will never forgive her, and i will never forget what she put me through.

One day however, when they are old enough, my sons will learn what their mother did in their name, and they will be able to make their own judgement.

I will always know that i behaved decently and can sleep at night because of it.

I cant ask for more than that and i'm happier now than i've been in my entire adult life.
